INTRODUCTION AND GENERAL PRINCIPLES - GDPR
HABITO d.o.o. takes the protection of your personal data seriously and implements all necessary technical and organizational measures in accordance with best practices and obligations prescribed by REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: General Data Protection Regulation - GDPR) and the Act on the Implementation of the General Data Protection Regulation (Official Gazette 42/2018).
In its business operations, HABITO is guided by the fundamental principles of personal data protection under the GDPR, meaning that data is processed lawfully, transparently, and fairly; that processing is limited only to the purpose for which the data was collected; and that only data necessary for that purpose is processed.

DATA CONTROLLER
In accordance with the GDPR, HABITO, with its registered seat in Višnjan, Zagrebačka 15 B, acts as the Data Controller. Only authorized persons of the HABITO agency (the controller) and partners providing business support (data processors) have access to your personal data.

WHEN DO WE COLLECT YOUR PERSONAL DATA?
We may collect your personal data in the following ways:
- Via the website: We may collect and store personal data you enter when filling out contact forms, requests for information, listing properties in our offer, or providing data for callback purposes regarding properties with specific characteristics, etc.
- Direct contact: If you contact us, we may collect and store records of such correspondence, including any personal data provided during the interaction.
WHICH PERSONAL DATA DO WE COLLECT AND PROCESS?
HABITO processes personal data collected during the business relationship, such as: name, surname, OIB (Personal Identification Number), address, property details, and similar. For the execution of business activities, and if necessary regardless of a specific contractual or business relationship, we collect data from public sources (Court Register, Land Registry, FINA) or data legitimately disclosed to us by other contractual partners or third parties.
FOR WHAT PURPOSES DO WE USE PERSONAL DATA?
As the data controller, HABITO protects your privacy and processes only the personal data necessary for business activities. We use your data to:
- Verify your identity.
- Provide services you have contracted and fulfill obligations arising from contracts.
- Respond to your inquiries.
- Provide information and services you request when you have consented to be contacted.
- Send notifications regarding changes to our services.
- Send promotional emails, provided you have given explicit consent.
- Prevent fraud.
LEGAL BASIS FOR DATA PROCESSING
The GDPR prescribes the following legal bases for lawful processing:
- Performance of a contract: When processing is necessary to take steps at your request prior to entering into a contract or to fulfill contractual obligations (e.g., organizing viewings, providing property addresses, invoicing, etc.).
- Legitimate interests: When necessary for our legitimate interests outside of a specific contract. This includes legal proceedings, crime detection, fraud prevention, protection of persons and property, and improving our services/communications.
- Compliance with legal obligations: HABITO must comply with Croatian regulations, such as accounting laws (invoicing), the Anti-Money Laundering and Terrorist Financing Act, and the Real Estate Brokerage Act.
- Consent: When you have given consent for specific purposes. You retain the right to withdraw your consent at any time.
DATA RETENTION PERIOD
We store your data only as long as necessary to fulfill the purpose for which it was collected (contractual/legal obligations or legitimate interest). If processing is based on consent, it ceases upon withdrawal of consent. Once data is no longer needed, it is destroyed unless further storage is required by law.
WITH WHOM DO WE SHARE PERSONAL DATA?
HABITO undertakes to keep your data confidential and will not disclose it to third parties without your specific approval, except to:
- Service providers (Processors) involved in the execution of your contract (e.g., law firms, accounting services, utility transfer services).
- Competent authorities within their jurisdiction (e.g., Tax Administration).
- Courts or State Attorney's Offices in legal proceedings.
- When required by law.
YOUR RIGHTS UNDER THE GDPR
- Right to Restriction of Processing: You can request a restriction if you contest data accuracy, if the processing is unlawful, or if we no longer need the data but you require it for legal claims.
- Right of Access: You have the right to ask what data we hold about you and how we process it.
- Right to Erasure (Right to be Forgotten): You may request the deletion of your data if it is no longer necessary for its original purpose, provided there is no conflicting legal obligation to keep it.
- Right to Rectification: You have the right to have inaccurate or incomplete data corrected without delay.
- Right to Object: You can object to processing based on legitimate interests.
- Right to Data Portability: You have the right to receive your data in a structured, machine-readable format and transfer it to another controller if technically feasible.
